Employers Must Begin Using Revised Form I-9 by January 22, 2017

 

The United States Citizenship and Immigration Service ("USCIS") has issued a revised Form I-9 Employment Eligibility Verification for employers to utilize when hiring a new employee.  Employers can voluntarily begin using the revised form immediately, but must start using the form no later than January 22nd.

 

As a reminder, employers must have new employees complete Part 1 of the Form I-9 on or before an employee's first day of employment.  Employers must complete Part 2 of the form no later than three days following the employee's date of hire.  In counting the three days, the first day of employment is day one.

USCIS provides a fillable PDF of the form that you can choose or a paper copy you can print and handwrite in the information collected.  If you choose to utilize the fillable PDF, and you input the information into Part 1 for the employee, remember to have the employee review Part 1 for accuracy and sign the form.  As the preparer, you will also need to complete the section requesting information about the preparer.     

 

Retention periods for keeping Form I-9s have not changed.
